Communications
From: Anthony Roberts
To Whom It May Concern:
Pursuant to the Freedom of Information Act, I hereby request the following records:
I am seeking emails, memorandum, and correspondence that reference FDA warning letters, withheld from being sent to government witnesses and informants, from January 1st, 2014 to June 15th, 2018.
I have obtained court documents (USA v. Patel. 1:16-cr-00034-JPJ-PMS Document 132)
revealing that the FDA failed to send a warning letter to the owner of Serious Nutrition Solutions, as a benefit of his cooperating with the government. I specifically request all communications regarding this unsent letter, and generally all similar instances regarding other dietary supplement companies, through the aforementioned dates.
My request is therefore, for all such withheld warning letters and documents, plus all discussions/communications that reference the withholding of those letters.
I also hereby request all communications with the dietary supplement firms in question, who received the benefit of an unsent warning letter.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Anthony Roberts

I am still waiting on this request. I timely replied to your last communication and it is now approaching two years since filing this request. Should you wonder if I sill want these documents, you needn’t send another communication to that’s effect, as the answer is yes, as it was last time (and the dozen other communication s before that, plus the multiple phone calls and conversations), and the numerous times I rearticulated, with particularity, the documents being requested, and the reasons for the request and why the public ought to know the details of a government informant being allowed to sell dietary supplements that have been deemed unsafe by FDA.
