This is a request under the Freedom of Information Act. I hereby request the following records:

I am seeking all correspondence and records/copies of correspondence between the FDA and local/state law enforcement agencies regarding kratom. In the case that these correspondences were made via physical mail or email, I am seeking copies. In the case that there were phone calls made (conference calls or individual calls), I am seeking both records of their existence and metadata where available (i.e. length of call, numbers called, names of people on the call, etc...plus internal memorandum and emails that reference those calls).

I am also seeking any and all records of correspondence between the FDA and credit card processing services regarding kratom, which should be construed as a request for the same detailed information as above.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is to serve as my official appeal to Freedom of Information Act request 2017-4212. While I recognize that perhaps information compiled for law enforcement purposes is not disclosable because it may interfere with proceedings, minimally it would seem that the request ought to have been granted in part, as the request included simple records and metadata (i.e. the time and date that a phone call was made, and to who, etc...). It strains even the most vivid imagination to picture a scenario where public disclosure of the time and date of a phone call would reasonably be expected to interfere with law enforcement proceedings.
