This is a request under the Freedom of Information Act. I hereby request the following records:

Any memos or correspondence between the FCC and FBI regarding the requirement for state and local law enforcement agencies to "advance coordinate" with the FBI before acquiring or using a Harris Corporation cell site simulator, commonly known as a StingRay.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

To Whom It May Concern:

I hereby appeal the adequacy of the search for FOIA request 2015-019, in which I requested:

"Any memos or correspondence between the FCC and FBI regarding the requirement for state and local law enforcement agencies to "advance coordinate" with the FBI before acquiring or using a Harris Corporation cell site simulator, commonly known as a StingRay."

In the attached response, the FCC indicated that it had been unable to find a single responsive document. Given the consultation between the FCC, the FBI and the Harris Corporation regarding this technology and the FCC's approval for its use by law enforcement nationwide, it is difficult to believe that no memos or other correspondence exists between the FBI and the FCC on this matter.

As such, I request that you remand this FOIA back for a good faith search for responsive documents.
