This is a request under the Freedom of Information Act. I hereby request the following records:

I would like copies of all complaints to the Federal Communications Commission regarding the following shows:

PlayTV (shown on KAZA-TV in 2007)
Midnight Money Madness (shown on TBS in 2006)

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request, preferably with a detailed breakdown of said fees. I would prefer the request filled electronically, by e-mail attachment if available.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This email responds to your recent Freedom of Information Act (FOIA) request received by the Federal Communications Commission (FCC or Commission) and assigned to the Consumer & Governmental Affairs (CGB) and Enforcement (EB) Bureaus. Your request seeks complaints filed with the FCC regarding the following two shows:

PlayTV (shown on KAZA-TV in 2007)
Midnight Money Madness(shown on TBS in 2006)

According to the Commission's Records Control Schedule for Informal Complaints ("Records Control Schedule"), the Commission is not required to maintain informal complaints and related correspondence for more than three years after the case is closed. See N1-173-07-1, FCC Disposition Authority. Therefore, all complaint records prior to January 1, 2010, have been purged pursuant to the Records Control Schedule. Since your request is for complaints dating back to 2006 there are no documents responsive to your request. Consequently, your FOIA file will be closed.

If you think this response denies your FOIA request, you may file an application for review of this decision with the FCC's Office of the General Counsel within 30 days. Both the application and envelope containing it must be marked "Review of Freedom of Information Action" and the application should refer to FOIA Control No. 2013-504.
