I am writing to formally appeal the implicit denial of my Freedom of Information Act (FOIA) request, reference number #FCC-2023-000397, which was submitted to the Federal Communications Commission on March 5, 2023.

Background:
My request sought all complaints relating to all shows and content on the networks: CNN, FOX, and MSNBC.

Timeline of Correspondence:

March 5, 2023: FOIA request submitted.
March 30, 2023: FCC requested clarification due to the large number of potential records.
March 31, 2023: I provided the requested clarification.
As of Aug 11, 2023 I have not received the requested records or any further communication from the FCC regarding the status of my request.

Basis for Appeal:
The prolonged delay without a substantive response or valid reason constitutes an implicit denial of access to the requested records, which is in violation of the Freedom of Information Act.

Action Requested:
I kindly request that the Federal Communications Commission:

Acknowledge this appeal in writing within the stipulated timeframe.
Conduct a diligent search for the requested records.
Provide the requested records without further delay or provide a valid legal basis for withholding them.
I appreciate your prompt attention to this matter. Please understand the importance of transparency and the public's right to access records under the Freedom of Information Act.

While I understand the complexity of processing over 7,000 complaints, I would like to express my concern about the proposed timeline of 90-120 days or more to complete the request.

As you may recall, my original request was submitted on March 5, 2023, and I have been actively engaged in correspondence to clarify and expedite the request. The prolonged delay has already impacted the timeliness of accessing these records.

I kindly request that the FCC consider prioritizing this request and explore ways to reduce the processing time, if possible. If there are specific categories or subsets of complaints that can be provided more quickly, I am open to discussing a phased approach to receiving the records.
