This is a request under the Freedom of Information Act. I hereby request the following records:

The contract used to purchase and maintain the FCC complaint database software (Consumer Information Management System, CIMS) as well as any end-user and IT documentation and configuration manuals for this system.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

We have received your FOIA Request seeking “the contract used to purchase and maintain the FCC complaint database software (Consumer Information Management System, CIMS) as well as any end-user and IT documentation and configuration manuals for this system."

We have begun to process your request, and have discovered a few things that could impact whether you wish us to continue. First, it's important to point out that CIMS was developed a long time ago. As a result, in accordance with FAR Subpart 4.7, the initial contract has been sent to the National Archives and is no longer in our possession. The same is true for any end-user and IT documentation that may have once been created. Therefore, we will be unable to provide any responsive documents to this portion of your FOIA request. We will send you a formal response containing this same information, but are passing it on now in this informal manner for you to consider.

With regard to your request for contracts to maintain the database: Although the Commission continues to enter contracts for the maintenance of CIMS, these contracts also encompass the maintenance of other Commission systems, and the fees and costs are not broken out by system. Therefore, it will be impossible for you to calculate the costs related solely to the maintenance of CIMS. For this reason, could you confirm whether you still wish to receive copies of these contracts? If you wish for us to proceed, we note that it may take some time to provide these documents to you, because the Commission's rules require us to give each vendor the opportunity to raise objections to the release of what it considers to be confidential and privileged commercial information. Because there are multiple vendors that have been retained to maintain CIMS over the years, this coordination process may take some effort for (what may be) little benefit to you.

Given these facts, please let us know if you would still like for us to process your request. Pursuant to the Commission's rules, the time for the agency to finalize its response will be tolled until we receive a response from you. If we don't receive a reply within ten days, we will consider your FOIA request to be withdrawn. In that event, however, you are always free to refile your request another time.

We have begun to process your FOIA request, in which you sought the contracts to maintain the Consumer Information management System, as well as the contract used to initially purchase the system. As explained earlier, we no longer have that contract in our possession, and it may be retained at NARA. Upon reviewing our files, we have discovered that the work may have begun as part of two contracts: contract CON01000013, Task 2001-33 with Advanced Technology Systems, Inc., or possibly FCC 96-06 Task 00-22 with Dyncorp. As these are very old contracts, we have no way of knowing whether they were sent to Archives or simply disposed of. We hope this is helpful.

However, due to the type of the materials sought, we will be unable to respond to the remainder of your request by the initial deadline. Would you consent to a short extention until Friday, May 17, 2013, for the Commission to finalize its response? An extension would just be for administrative purposes, and wouldn't impact the attention we are giving your FOIA request or the time needed to respond.

Thank you for your reply. The Commission's rules allow for 10 calendar days to raise objections to the release of information such as that incorporated into a Commission contract. See 47 C.F.R. s 0.461(d)(3). Given our experience from processing similar FOIA requests in the past, a ten-day period should be sufficient to conduct a throrough review of the documents and raise any objections. Thus, with this in mind, we will provide you with an electronic copy of the contractual materials by the end of the day, and grant you an extention for your time to file a response until ten calendar days from now, which would be Monday, April 29.
