This is a request under the Freedom of Information Act. I hereby request the following records:

The current agreement between the FBI and the Department of Justice, Civil Rights Division regarding the reporting of incidents that result in injury or death.

Per a 2004 DOJ IG report (available here: http://www.justice.gov/oig/reports/plus/e0410/final.pdf):

In 2000, the CRD established written agreements with the DEA and the FBI that require them to report incidents
that result in injury or death.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This office began searching for records responsive to your request on July 7, 2014.

In an effort to treat requesters fairly, this office attempts to respond to requesters in the approximate order of receipt.

Currently there are 145 requesters whose requests arrived prior to your request.

There are several tracks of response times depending on the volume of responsive records, the number of components with whom

this office must consult and the complexity of the subject matter.

Since it appears there may be only one responsive document, I am hopeful that the Division will be able to locate the relevant record

and respond to you on a faster track. Once located, the document may require consultation with all parties to the agreement prior

to any disclosure determination.

At this time, this office has not completed its standard thorough search to locate the agreement and any associated records.

We'll appreciate your understanding as we set forth to fully comply with your request.

I had mentioned that I would touch base with you once again on September 23.

I have continued to search. As I'm sure you're aware, sometimes it takes a while to locate particular documents
amongst millions within the Civil Rights Division.

We're hopeful that we will be able to find these soon. I have two people working on this within the
Section most likely to contain the records.

My hope is to provide you with a response by the end of this month which, of course, will only occur if
we are successful in the search.

If not, then we'll continue to search until we believe we've exhausted all possibilities.
