This is a request under the Freedom of Information Act. I hereby request the following records:

All communications between the FAA UAS Integration Office and/or FAA spokespersons and FlowerDeliveryExpress.com and/or its president, Wesley Berry, regarding FlowerDeliveryExpress.com proposal and testing of a Valentine's Day flower delivery service via unmanned aerial vehicle.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I have attached the acknowledgement letter for this request, which includes no indication whatsoever of fee category, much less that I have been deemed commercial. As I'm sure you're aware, a commercial fee categorization requires a determination on your part that the primary purpose to which I will put this information is commercial. No such determination or evidence of such decision-making has been provided, nor would such a determination be correct.

In light of the above, please advise as to whether your office will require a formal fee category appeal to be filed, at considerable waste of time to your staff.

Good Morning Mr. Musgrave,

This message is in reference to your FOIA Request 2014-008811 submitted on February 16, 2014 requesting records of communication between the FAA and FlowerDeliveryExpress.com regarding FlowerDeliveryExpress.com proposal and testing of a Valentine Day flower delivery service via UAS. I sincerely apologize for the delay in replying to your request, our office is undermanned and we have a large backlog of FOIA cases. We are currently doing research on the information that you have requested. I need to negotiate an extension of 45 days (weekday) from August 11, 2014. A new due date of October 15, 2014 is requested to complete your FOIA case.
