Hi,

This is an appeal of my fee categorization and fee assessment for request EPA-HQ-2016-001062.

I was miscategorized as a commercial requester after explicitly stating that I was not making the request for commercial purposes. I am a journalist and was filing this request in my capacity as a reporter with MuckRock News, an online news organization well known for its original reporting.

You can see one of my stories here:

https://www.muckrock.com/news/archives/2015/nov/10/veterans-administration-executives-abused-incentiv/

MuckRock is a widely read, highly cited news source that informs a broad audience of topics of general interest on the operations of government, and my work with them clearly puts me in the news media fee category.

Additionally, the original letter sent notifying me of my fee category misclassification stated that the agency would tell me in advance of fees if they were above $25. The agency failed to do this, instead notifying me of fees of $54.50 only after fulfilling my request, denying me the opportunity to agree or disagree to pay the fees, an opportunity that was specifically asked for in my original request.

When properly placed in the media fee category, I believe there will be no assessible fees since the released documents total less than 100 pages.

Thank you for your consideration,

Brian
