September 01, 2020 SENT VIA E-MAIL TO: requests@muckrock.com Re: FOIA Request Number 2020-FEFO-00433 Acknowledgment Dear Mr. Christopher Sheats: This email acknowledges receipt of your Freedom of Information Act (FOIA) request to the Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), dated and received in this office on March 02, 2020 .  You are seeking copies of internal presentations, reports, studies, memorandum, or proposals created or received by Federal Emergency Management Agency concerning software developed by The Tor Project, Inc., including but not limited to: - Tor - Tor Browser - Tor bridges - Tor onion sites (v2 or v3, sometimes called "darkweb" or "darknet" sites) - Tor onion services (v2 or v3, sometimes called "hidden services") - Tor bandwidth authorities or directory authorities - Tor pluggable transports (obfs4, meek, ScrambleSuit, etc) - Tor relays (also known as "routers" or "nodes", sometimes called "guard", "middle", or "exit" relays) The requested timeframe is from 2010-January-01 through the date the search for responsive records is conducted. Your request has been assigned the following tracking number 2020-FEFO-00433 . Due to current working conditions in response to the COVID -19 outbreak, please expect a delay in our response.  Please be assured that we continue our commitment to provide timely FOIA responses and are processing your FOIA request as soon as possible. Dueto the increasing number of FOIA requests received by this office, we mayencounter some delay in processing your request.  Consistent with the DHSFOIA Regulations 6 C.F.R. § 5.5(a), FEMA processes FOIA requests according totheir order of receipt.  Although FEMA’s goal is to respond within 20business days of receipt of your request, FOIA does permit a 10-day extensionof this time period in certain circumstances.  As your request seeksdocuments that will require a thorough and wide-ranging search, FEMA willinvoke a 10-day extension for your request pursuant to 5 U.S.C. §552(a)(6)(B).  If you would like to narrow the scope of your request,please contact our office.  We will make every effort to comply with yourrequest in a timely manner. We may contact you again  about more information about your FOIA request. You have been placed in the fee requester category "All Other" requester, pursuant to the DHS FOIA Regulations, 6 CFR § 5.11. Provisions of the FOIA allow us to recover part of the cost of complying with your request.  We shall charge you for records in accordance with the DHS FOIA regulations as they apply to "All Other" non-commercial requesters.  As a non-commercial requester, you may be charged 10 cents per page for duplication; the first 100 pages are free, as are the first two hours of search time, after which you will pay the per quarter-hour rate ($4.00 for clerical personnel, $7.00 for professional personnel, $10.25 for managerial personnel) of the searcher. We will construe the submission of your request as an agreement to pay up to $25.00. This office will contact you before accruing any further fees. We will query the appropriate offices within FEMA who may have the records you are seeking to determine if fees will apply.
