April 10, 2017 Re:  Freedom of Information Act Request NGC17-255
Dear Mr. Smith:
This is in response to your Freedom of Information Act (FOIA) request dated March 13, 2017. Your request was assigned FOIAonline tracking number NARA-NGC-2017-000375, and the above internal tracking number.  In your request, you stated:
Emails, to or from, that contain the keyword "Swartz" (whether or not the first letter there is capitalized) in the account of Archivist David S. Ferriero. I request all emails in any email "chain" (that is, tied to responsive emails by reply) in which the string is found. The date range for this search is the entire date range of Mr. Ferriero's tenure at the agency, from November 6, 2009 to the date of this request.
A search was conducted of David Ferriero’s email account for any emails that contained the keyword “Swartz.”  I also extended the search using possible misspellings of the word, lower and upper case, and the plural use of the word.  There are six emails that are responsive.  Three of those emails are being denied in full pursuant to 5 U.S.C. §552(b)(6) for personal privacy.  The remaining three are being released to you in full.  There were additional emails that contained the name “Swartz,” but they were all news stories or photographs by individuals with the same name.  Should you want those emails too feel free to contact me and I will be glad to send the published news links.  This completes the processing of your request.
If you are not satisfied with our action on this request, you have the right to file an administrative appeal within ninety (90) calendar days from the date of this letter via regular U.S. mail or email.  By filing an appeal, you preserve your rights under FOIA and give the agency a chance to review and reconsider your request and the agency’s decision.  If you submit your appeal in writing, please address it to the Deputy Archivist of the United States (ND), National Archives and Records Administration, 8601 Adelphi Road, College Park, Maryland 20740.  Both the letter and the envelope should be clearly marked “Freedom of Information Act Appeal.”  If you submit your appeal by e-mail please send it to FOIA@nara.gov, also addressed to the Deputy Archivist of the United States. Please be sure to explain why you believe this response does not meet the requirements of the FOIA.  All correspondence should reference your case tracking number NGC17-255.
If you would like to discuss our response before filing an appeal to attempt to resolve your dispute without going through the appeals process, you may contact our FOIA Public Liaison Gary M. Stern for assistance at:
