This is a request under the Freedom of Information Act. I hereby request the following records:

I'm seeking any emails sent from info@vice-mag.com to Melzian.Brian@epa.gov.

Brian Melzian attempted to sign up for the daily Motherboard Premium newsletter, which delivers five stories on technology and science in the afternoon.

Melzian says he has not received the emails and that they were not sent to his junk or spam folder. I would like to confirm this.

This request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Hi,

This is an appeal of my fee categorization and fee assessment for request EPA-HQ-2016-000669.

I was miscategorized as a commercial requester after explicitly stating that I was not making the request for commercial purposes. I am a journalist and was filing this request in my capacity as a journalist and managing editor of Motherboard, a news organization well known for its original reporting.

Motherboard, part of VICE Media, is a widely read, highly cited news source that informs a broad audience of topics of general interest on the operations of government, and my work with them clearly puts me in the news media fee category.

Additionally, in my original letter I asked that I be notified of fees in advance. The agency failed to do this, instead notifying me of fees of only after fulfilling my request, denying me the opportunity to agree or disagree to pay the fees, an opportunity that was specifically asked for in my original request.

When properly placed in the media fee category, I believe there will be no assessible fees since the released documents total less than 100 pages.
