This is a request under the Freedom of Information Act. I hereby request the following records:

Any and all correspondence, printed or electronic, exchanged between July 6, 2013, and July 31, 2013, between all employees and interns of the National Transportation Safety Board and all employees and interns of either of the following entities: the Cox Media Group, headquartered in Atlanta, Georgia, and KTVU Channel 2 News, located in Oakland, California.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Hello,

I am again writing to follow up on request #FOIA-2013-00355 (and similar requests for the same records. Does the NTSB intent to fulfill this request before the end of the year?

The records requested in #FOIA-2013-00355 are narrowly defined, originate from a narrowly defined time period, and were requested more than four months ago. It is not clear what the delay behind these documents is, especially given NTSB’s status as a federal agency that periodically receives and complies with many FOIA requests, many of which exceed the complexity and scope of the request in question, which is for a series of emails exchanged between NTSB interns and a handful of news outlets.

The bureau’s FOIA office has twice now stated that the request would be fulfilled “soon”—first on August 28 (more than a month after the original request) and again on November 28—without any explanation of what that means. Does it mean a month from now? A year from now?

The delay in fulfilling this request is concerning. Does the bureau’s FOIA office have any realistic sense of when these records are going to be released?

Please acknowledge receipt, and please clarify why the release of the requested records has been repeatedly delayed.

Please note we inadvertently applied the following exemptions (b)(1), (b)(2), and (b)(7)(a) to three of the pages (pages, 186, 758, and 855) we released in part regarding the above referenced FOIA request.
