This is a request under the Freedom of Information Act. I hereby request the following records:

Emails, letters, faxes and all other written or electronic communications produced by the U.S. Securities and Exchange Commission concerning the following three entities: Intercol (PTY) Ltd., a South African corporation; Oceantec Group/Syndicate, a corporation based in Greece; and Eastech International Bank Ltd. Please also include Emails, letters, faxes, and all other written or electronic communications delivered to the U.S. Securities and Exchange Commission concerning these entities, for example, in the form of consumer complaints, complaints from foreign governments, individuals, and corporate entities. Please limit this search to the years between and including 1980 and 2004.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

For clarity, are you focused on (1) Consumer complaints or (2) any and all records, pertaining to these companies? If you are seeking documents pertaining to the latter, please understand that one investigation could contain as little as one box of material to several hundred boxes, as well as digital material. This material, if it exists, would have to be reviewed line-by-line and page-by-page, which could take, based on our past experience, and extensive amount of time to complete, especially as it relates to e-mail traffic. Before we proceed further, it would be helpful to lock this down.

If we can assist in any way, please let me know.

Dear Dave Henshall, Frank Mandic, and others at the SEC's Office of FOIA Services:

First, thanks for your timely replies and efforts. I know this will be a lot of effort, but the request that I'm making is definitely closer to the latter of the two options that Dave Henshall has put out there for clarification, i.e. "(2) any and all records, pertaining to these companies" I respect and understand that this could take a while and might be a lot of records; I'm genuinely curious about these companies in a journalistic capacity and am not sure that simple consumer complaints would be sufficiently useful on their own.

I can attempt calling Mr. Henshall at 202.551.8316 (correct?) or someone else there to discuss more over the phone if needed.

Or anyone over there can try contacting me on my cell, 917.859.1266.

Thanks again for your time; I suspect that this is underfunded, under-respected work and time-consuming beyond that. Please let me know if any more clarifications are needed.

Mr. Phelan,

I will get a little clearer picture of what is involved as it relates to the potential records available shortly. Please be aware that we only maintain consumer complaints for four years. As such, it is highly unlikely that we would still maintain consumer complaints submitted between 1980 and 2004. As for investigative material, we will conduct research in an effort to identify the materials of interest to you, if they exist.

We will be unable to respond to your request within the Freedom of Information Act's twenty day statutory time period, as there are unusual circumstances which impact on our ability to quickly process your request. Therefore, we are invoking the 10 day extension. These unusual circumstances are: (a) the need to search for and collect records from an organization geographically separated from this office; (b) the potential volume of records responsive to your request; and (c) the need for consultation with one or more other offices having a substantial interest in either the determination or the subject matter of the records. For these reasons, we will process your case consistent with the order in which we received your request.
