Communications

From: Andrew Free

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

1. DOJ communications with DHS-OIG regarding the latter office's criminal investigation into the May 15, 2017 death of Jeancarlo Jimenez Joseph in U.S. Immigration and Customs Enforcement Custody. DOJ reportedly declined criminal prosecution in March or April of 2019 after a nearly 24-month DHS-OIG criminal probe. It is believed that records will be located in DOJ's Criminal Division and/or in the office of the U.S. Attorney for the Middle District or Northern District of Georgia.
2. Any other DOJ records relating to the DHS-OIG criminal investigation into Mr. Jimenez's death not encompassed in Item 1 above.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Andrew Free

  • 300697176 Free, Andrew (Final Unperfected Acknowledgment Letter)

From: Andrew Free

Dear FOIA/PA Officer:

I am in receipt of your letter dated May 22, 2019, requesting additional information regarding the declined criminal prosecution involving the death of Jeancarlo Jimenez-Joseph at ICE's Stewart Detention Center in Lumpkin, Georgia on May 15, 2017.

The United States Attorney's Office for either the Middle District of Georgia, the Northern District of Georgia, or the District of Columbia declined to prosecute any crimes involving this case, based on presentation to that office by the Department of Homeland Security, Office of Inspector General.

Consequently, there is no case number or court information publicly available. I have specifically described the records, locations, and time periods I seek, and hereby renew my request that DOJ process this request within the statutorily required period.

We are attempting to locate the promised correspondence referenced in your July 5, 2019, letter. In this response, we understand that the Executive Office for United States Attorneys (EOUSA) would be responding to this request, because you forwarded it to that office.

We cannot locate that response, and are unable to confirm receiving it.

Can you please indicate whether EOUSA has responded, and if so, provide a copy of that response, or give us a reference number or contact so we can ask EOUSA FOIA to do so?

Many thanks,
