I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I have received the FBI FOIA Office's letter dated January 7, 2015 with regard to FOIA 1276198-000 — in that letter, the FBI requested additional details so that records staff could conduct a search for responsive documents.

This is a request for communications/correspondence between the FBI and partner law enforcement agencies at the state and local levels regarding the use of cell site simulators, StingRays, IMSI catchers or analogous cell phone surveillance technologies. This request covers communications sent from March 1, 2014 to the date this request is processed.

I believe that this ought to be sufficient level of detail for FBI FOIA staff to conduct a search for records, in that it is my understanding that the FBI has files dedicated to StingRay/IMSI catcher technology. This understanding is based on the files released by the FBI pertaining to its unmanned aerial vehicles (UAVs) following FOIA litigation.

This is an appeal of the FBI's response to request 1276198-001, in which I requested:

"All memos, bulletins, emails or any other correspondence sent to federally deputized state and local law enforcement regarding records requests related to cell site simulators, Stingrays and other cell phone surveillance technologies. Please include such correspondence from March 1, 2014 to the date this request is processed."

In the attached response dated May 22, 2015, the FBI refused to confirm or deny that such records exist, on the basis that, "Acknowledging locale or field office information about enforcement techniques or capabilities invites the risk of circumvention or otherwise disclosure of federal law enforcement efforts."

The FBI has lost significant FOIA lawsuits around cell site simulators. Considerable documentation has been released by the FBI pursuant to these lawsuits, including the nondisclosure agreements that state and local law enforcement must sign prior to obtaining cell site simulator technology. Documents released by many of these state and local law enforcement partner agencies have further elucidated reporting requirements. In short, documents already released to the public undermine further claims that releasing the requested documents would particularly "risk circumvention" or disclose federal law enforcement efforts. These matters have already been disclosed in considerable detail.

Furthermore, the FBI itself has made public statements regarding its agreements with state and local law enforcement partners. In response to inquiries from the Washington Post (see www.washingtonpost.com/world/national-security/fbi-clarifies-rules-on-secretive-cellphone-tracking-devices/2015/05/14/655b4696-f914-11e4-a13c-193b1241d51a_story.html), an FBI spokesperson clarified that its nondisclosure requirements "do not prevent police from disclosing that they used such equipment, often called a StingRay," per Washington Post reporting. An FBI spokesperson also told the Post that the agency had not invoked a provision in the NDA regarding the FBI's ability to request that charges be dropped in cases where going to court risks revealing cell site simulator deployment or procedures.

The FBI has ceded its ability to "neither confirm nor deny" the existence of most documents regarding StingRay deployments, particularly when it comes to their use by state and local law enforcement partners.

As such, I request that you remand this request back to the FBI for a good faith search and provision of responsive documents. Where relevant exemptions do apply, I respectfully assert my right to receive partially redacted documents rather than have the FBI withhold these documents in full.
