Re: DTIC-2011-27 though 29 and case number 0203-2011.

Director of Administration and Management, Office of the Secretary of Defense:

On Feb. 7, 2011 I made four requests for information in the DODTECHPEDIA system. Three of those requests were issued FOIA log numbers DTIC-2011-27 through 29. The fourth request was for “A copy of the records responsive to a search of DODTECHIPEDIA for RQ-1 Predator.” This request is still pending. I appeal the no response as more than 20 days have passed.

The three requests which were issued FOIA log number and were responded to were denied in full. I appeal.

The denial letter states many speculative reasons as to why the content in DODTECHPEDIA should be exempt. However, placing data in DODTECHPEDIA cannot in and of itself exempt the data from disclosure.

I hereby request that searches are done for all four requests for data from DODTECHPEDIA and that data is released to me. After searching for and reviewing the records, if any exemptions apply, I request a Vaughn index of all withheld records and specific exemptions for each individual redaction or withholding of responsive records.

Furthermore, I was placed in the other category for billing purposes. I appeal. I am a member of the news media. I intend to take the responsive records, use my editorial skills to turn them into a distinct work, and distribute them to an audience. I have proven myself capable of doing so in the past. Concerning my request for DODTECHPEDIA pages concerning Jesus, I am assured of publishing the distinct work on www.witnessesuntome.com, which I own and have demonstrated my ability to publish to a wide audience and my ability to turn raw records into a unique work using my editorial skills. Feel free to click the news link to review examples of this work. Concerning my request for DODTECHPEDIA pages concerning FOIA, I am assured of publishing the distinct work on muckrock.com where I have an agreement to write articles concerning FOIA and have been previously published. Concerning the request concerning DODTECHPEDIA itself and the RQ-1 Predator, I intend to write articles and submit them to a publication as a freelance writer.

Regards,
Jason Smathers

To Whom It May Concern:

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on Feb. 7, 2011. Please let me know when I can expect to receive a response, or if further clarification is needed.

Thank you for your help.

Dear Mr. Smathers:

My office was forwarded your status request by DTIC last Friday. As far as I can tell by this email chain, you seem to be enquiring about a FOIA appeal that you state you submitted on March 16, 2011. After a thorough search of our appeal case files, FOIA database, and Mr. Hogan's personal email, we have no record of this appeal.

Since three years has lapsed, I regret that we will not be able to accept this as a timely appeal. Please remember in the future, if you do not receive a timely acknowledgment from our office, please contact us right away.

Thank you.

The appeal was mailed using the USPS on March 16, 2011. Since it would make little sense to request the records again and then appeal, I ask that you process my appeal at this time.

Thank you.
