The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Musgrave:

This responds to your Freedom of Information Act (FOIA) request for report DODIG-2015-070, (U) Evaluation of Alternative Compensatory Control Measures Program. We received your request on March 9, 2015, and assigned it case number FOIA-2015-00441.

The former Intelligence and Special Program Assessments Component (now part of the Evaluations Component) conducted a search and found the enclosed document responsive to your request. In coordination with the Defense Intelligence Agency and the Office of the Secretary of Defense/Joint Staff, we determined that redacted portions in the enclosed record are exempt from release in accordance with the following FOIA exemptions:

. 5 U.S.C. § 552 (b)(1), which pertains to information that is currently and properly classified pursuant to Executive Order 13526, Section 1.4(a) [which pertains to military plans, weapons systems, or operations];

. 5 U.S.C. § 552 (b)(3), which pertains to information exempted from release by statute, in this instance, 10 U.S.C. § 424 [organizational and personnel information for the Defense Intelligence Agency];

. 5 U.S.C. § 552 (b)(5), which pertains to certain inter-and intra-agency communications protected by the attorney-client and deliberative process privileges; and

. 5 U.S.C. § 552 (b)(6), which pertains to information, the release of which would constitute a clearly unwarranted invasion of personal privacy.

If you consider this an adverse determination, you may submit an appeal. Your appeal, if any, must be postmarked within 90 days of the date of this letter, clearly identify the determination that you would like to appeal, and reference to the FOIA case number above. Send your appeal to the Department of Defense, Office of Inspector General, ATTN: FOIA Appellate Authority, Suite 10B24, 4800 Mark Center Drive, Alexandria, VA 22350-1500, or via facsimile to 571-372-7498.
