This is an interim response to your Freedom of Information Act request dated
November 1, 2013, seeking DoDIG-2013-127, "Inspection of DoD Detainee
Transfers and Assurances." We received your request on December 26, 2013,
and assigned it FOIA case number FOIA-2014-00208. We currently have an
administrative workload of 600 open cases. Please note that our fax machine

This is an appeal of the partial redaction of responsive documents for FOIA #14-FC-0030 (see attached letter), for which Mr. Steven W. Dabey, Chief of Staff, Detainee Affairs, Office of the Undersecretary of Defense for Policy, in his capacity as an Initial Denial Authority, determined that certain portions of an inspector general report were properly classified. I originally submitted this request to the Department of Defense Inspector General in November 2013. The DOD-IG assigned my request tracking number FOIA-2014-00208.

Given the length of time that has passed since the report at hand, which was issued in September 2013, I assert that the justifications cited by Mr. Dabey are overruled by the public interest in knowing how the Defense Department has conducted detainee transfers. I thus respectfully request that this report be remanded to the DOD IG for release in full.

Per the attached response from the DOD FOIA office dated July 5, my appeal for partial redactions as submitted has been sent back to DoDIG. Please note that I sent my appeal to DOD FOIA office in the first place at the direction of DODIG's partial denial letter dated May 17 (attached). I also appealed the partial redactions by CENTCOM, per directions in the same May 17 response letter. Please confirm whether my appeal of those redactions were appropriately sent to CENTCOM, or whether DODIG will address my appeals of those redactions, as well.

Thank you for your response.

In May 2016, I received a redacted copy of the requested document.

I appealed those redactions to the OSD/Joint Staff FOIA Appeals Office as well as to the CENTCOM Office of the Chief of Staff in a letter dated May 20, 2016. The final response letter from DoDIG (attached), directed me to appeal redactions to these two agencies.

However, OSD passed along my appeal to DoDIG, which acknowledged the same in a letter dated July 6, 2016 (also attached). Please note that this letter includes a new tracking number — FOIA-2016-00475 — but clearly refers to the same requested documents as for 2014-00208.

In light of the discrepancies as to the appropriate appeal authority, on July 20, 2016, I inquired to DoDIG whether my appeal had been appropriately forwarded. Since that date, I have only received responses from DODIG to the effect that this request is being processed. I received interim responses from DODIG to this effect on: December 19, 2016; February 17, 2017; March 22, 2017; April 21, 2017; and May 23, 2017. In each such response, the DODIG FOIA team indicated that the relevant request was DoD IG-2014-000208.

According to my records, I have never received any communication indicating that my appeal on DoD IG-2014-000208 / FOIA-2016-00475 has been closed.

Please confirm the current status, then, of this request and its corresponding appeal of redactions in the responsive document.
