This is a request under the Freedom of Information Act. I hereby request all guidelines, presentations, policy statements, legal opinions, memoranda, briefs, training manuals, emails, records and any other documents including communications and procurements relating to the Vulnerabilities Equities Process.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. I am a published independent reporter and a current contributor to Forbes (http://www.forbes.com/sites/runasandvik/). I have also had my journalism published on domestic and international blogs.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This letter constitutes a formal appeal under the U.S. Freedom of Information and Privacy Acts (5 U.S.C. 552/552a) and the regulations promulgated thereunder.

Along with a letter dated July 24, 2014, the Department of Commerce responded to my request for records relating to the Vulnerabilities Equities Process by saying no responsive records were found. You had assigned the request reference number DOC-OS-2014-000806.

The Department of Commerce performed an inadequate search for records responsive to my request, which is violative of the FOIA. I hereby appeal the inadequate search for records responsive to my request and request that the Department of Commerce conduct a new complete and thorough search for all guidelines, presentations, policy statements, legal opinions, memoranda, briefs, training manuals, emails, records and any other documents including communications and procurements relating to the Vulnerabilities Equities Process.

Dear Mr. Sandvik,

This office is in receipt of your e-mail, sent on August 19, 2014, to the Department of Commerce, Office of the Assistant General Counsel for Administration (the office responsible for reviewing Freedom of Information Act (FOIA) appeals), FOIA Appeals mailbox (foiaappeals@doc.gov) with the subject line “Freedom of Information Request #DOC-OS-2014-000806.” Your August 19, 2014 email seeks to appeal The Department of Commerce, Office of the Secretary’s (OS) July 24, 2014 decision of your FOIA request. Your August 19th e-mail, however, does not constitute a FOIA appeal because it does not include copies of your original FOIA request and OS’s final determination of your request, as required by Department of Commerce regulations. See 15 C.F.R. § 4.10(b).

Department of Commerce regulations provide that an appeal must be filed by 5:00 pm E.S.T., with-in 30 calendar days of the date of the agency’s initial written denial. 15 C.F.R. § 4.10(a). In order for your submission to be considered a perfected and timely appeal, it will have to be received by 5:00 pm on August 22, 2014 with all of the required documentation. See 15 C.F.R. § 4.10(a). If all documentation is not received by 5:00 pm E.S.T. on August 22, 2014 your appeal will not be considered because your submission will be considered as untimely and unperfected.
