Pursuant to the Freedom of Information Act, I hereby request the following records:
I'm seeking any and all documentation created by the Department of Education between the dates of Jan 2017 up to the current date of this request regarding the department of education's policy-based handling of transgender students. I want all memorandums, and emails that contain discussions on the matter of policy development for transgender students and any supporting decision making documentation to shed light on how the department of education has come to adopt the stance they have on students who fall into this category.
Some of this information may also include discussions with other outside organizations including private entities and other governmental organizations, and please include documentation of this kind in the search.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Please specify exactly the types of documents you are looking for and from which program offices. In reference to transgender student issues, we need to know the offices you would like for us to search that you think might have responsive records. OCR, in particular, deals with transgender student issues. If you want records from OCR, you may want to consider a search for transgender complaints and/or resolution letters. In reference to emails and memorandums, please provide a list of Department employees that you think may have been involved in handling transgender student issues. We look forward to a response from you by 12/19/2018. If no response, then your request will not be processed. Thank you.

Asking for a citizen to specify which sub-groups I think might have the information that I'm looking for is unreasonable. I'm not an employee of the department of education, nor have I ever been, so I do not possess the institutional knowledge to help guide you to where these documents may live. I'm interested to know how the b(5) exemption applies to the bulk of the communications here. I've noticed that it's used liberally throughout the released documentation and I'm confused about how so much of the contents can be withheld using the b(5) privilege. Please advise how b(5) specifically applies so that I can better understand on what grounds this information is being withheld.
