To Whom It May Concern:
Pursuant to the Freedom of Information Act, I hereby request the following records:
All records related to the disposition of the 7,500 "packages" (or boxes of 16 tablets each) of Arakoda®-branded tafenoquine obtained for a total award amount of $2,137,500 under CLINs 0001 and 0002, from vendor 60 Degrees Pharmaceuticals (60P), via contract W81XWH-19-C-0181, including records of transfer, use, or disposal by USAMMDA from the time of its receipt from 60P from the contract's ship-to address of 1430 VETERANS DR FT DETRICK MD 21702 in 2019 to the date of the processing of this request. According to documentation provided by USAMRDC, these tablets were to be used for "user acceptability testing" and are to expire in November 2020.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

FOIA APPEAL

Attention: FCMR-AAZ-A

Re: Unacknowledged FOIA Request dated July 20, 2020
Dear General Counsel,
This is an appeal pursuant to the Freedom of Information Act (FOIA), concerning the U.S. Army Medical Research and Development Command's ("USAMRDC") constructive denial of a properly submitted FOIA request dated July 20, 2020 for the following records:
"All records related to the disposition of the 7,500 'packages' (or boxes of 16 tablets each) of Arakoda®-branded tafenoquine obtained for a total award amount of $2,137,500 under CLINs 0001 and 0002, from vendor 60 Degrees Pharmaceuticals (60P), via contract W81XWH-19-C-0181, including records of transfer, use, or disposal by USAMMDA from the time of its receipt from 60P from the contract's ship-to address of 1430 VETERANS DR FT DETRICK MD 21702 in 2019 to the date of the processing of this request. According to documentation provided by USAMRDC, these tablets were to be used for 'user acceptability testing' and are to expire in November 2020."
The original request can be seen at https://www.muckrock.com/foi/united-states-of-america-10/disposition-of-arakoda-branded-tafenoquine-purchased-under-contract-w81xwh-19-c-0181-98479/.
USAMRDC's refusal to acknowledge this request, and to respond to this request in accordance with the timelines required by law, constitutes a violation of the FOIA. By this letter, I am making a timely appeal pursuant to the FOIA in response to the Agency's constructive denial.
Please respond to my appeal within the timelines required by the statute. I thank you in advance for your assistance.
Sincerely,
Dr. Remington Nevin
