Hello -

DTIC guidelines for security reviews indicate that the DTIC Office of Security Review (OSR) is responsible for reviewing such IT specifications as I've cited in my FOIA request.

A copy of these guidelines are on the DTIC website here: http://www.dtic.mil/whs/esd/osr/docs/2012SR_InfoSheet2.pdf

Please confirm that the search conducted for this request included OSR documents. If OSR documents were not searched, please conduct a good faith search.

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on Nov. 13, 2014. Please let me know when I can expect to receive a response, or if further clarification is needed. You had assigned it reference number #DTIC FOIA 2015-171.

Thank you for your help.

From: Shawn Musgrave

Defense Freedom of Information Policy Office
Attn: Mr. James Hogan

Washington, DC. 20301-1155

To Whom It May Concern:

This is an appeal for inadequate search by the Defense Information Technical Center (DTIC) in response to my FOIA request, DTIC FOIA 2015-171.

On 11/13/2014, I requested the following documents:

"The following approval documents for release of technical information by Digital Receiver Technology, Inc., as referenced in the attached specification sheets (see red boxes at foot of each spec sheet):

14-S-2061
14-S-2062
14-S-2063
14-S-2064."

I attached to my original request four specification sheets, one of which I have included for reference.

In a response dated June 18, 2015, the DTIC FOIA office indicated that its search did not uncover any records responsive to my request. I hereby appeal the adequacy of the search, in light of indications that the relevant specification sheets were reviewed by the DTIC's Office of Security Review (OSR).

As indicated in my original request, each of the noted specification sheets for Digital Recognition Technologies products has a red box at the bottom that reads, in part, "Approved by DoD/OSR for public release."

Per instructions posted on the DTIC website (see http://www.dtic.mil/whs/esd/osr/docs/2012SR_InfoSheet2.pdf), documents are submitted to the Office of Security Review (OSR) by contractors as follows: "All DoD contractors should submit
requests for security review using corporate letterhead only (no DD Form is required)."

Given that Digital Received Technology included explicit indication of review by OSR that corresponds to OSR submission instructions, it is unlikely that DTIC conducted a thorough search for the requested documents. As such, I request that you remand this request back to DTIC for a good faith search and provision of responsive documents.

Respectfully,
Shawn Musgrave

From: Rupp, Connie H CIV USSOCOM HQ

Good morning Mr. Musgrave,

The U.S. Special Operations Command (USSOCOM) Freedom of Information Act (FOIA) Office was in receipt of a referral/request for information from the Defense Technical Information Center (DTIC) (FOIA 2015-171), which you initially submitted to DTIC (request attached). Documents, presumed to be responsive by DTIC, were referred to USSOCOM for review and direct response to you (referral letter attached). We assigned the request control number USSOCOM FOIA 2015-263.

Upon further review with various subject matter experts, USSOCOM found the documents located by DTIC to be non-responsive to your request.

We believe your request would best be responded to by the Office of Freedom of Information (OFOI). If the information you requested is still required, please submit your request electronically to OFOI at: http://pal.whs.mil/palMain.aspx, or in writing to the below address; OFOI will coordinate with the Defense Office of Prepublication and Security Review, who handles any matters pertaining to security reviews related to technical matters.

USSOCOM FOIA 2015-263 is closed with no further action from this office.

Thank you and have a good day!

Kind Regards,

Connie
