From: Shawn Musgrave
To Whom It May Concern:
This is a request under the Freedom of Information Act. I hereby request the following records:
-All processing notes, memos, evaluation forms or reports produced as part of processing 2014-HQAP-00073
-All emails sent to or from USCG Attorney Advisor Heather MacClintock between June 1, 2014 and the date this request is processed that contain either of the following keywords:
"Musgrave"
"MuckRock"
"watchlist"
To be clear, for the second item above, this is a request for separate keyword searches to be performed on Ms. McClintock's email account for each of the three indicated keywords. Please do not eliminate duplicate emails.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Shawn Musgrave

To be unmistakably clear, I am a news media requester who has published dozens of articles pertaining to FOIA and freedom of information on MuckRock as well as other outlets.
See, for example:

As additional evidence of my qualification as a journalist, please consider the fact that two of my investigative projects have been funded by the Fund for Investigative Journalism:
http://fij.org/shining-a-light-on-boston-public-housing/
http://fij.org/under-all-seeing-eyes/
And, again, to be unmistakably clear, I assert that I am making this request in my capacity as a reporter. In addition to provide the documents I obtain under this FOIA request to the public for no charge via MuckRock, I will use my editorial skill to analyze and synthesize them into a unique work for public consumption. I assert that my primary interest in these documents is journalistic in nature in an attempt to inform the public about the processing of Freedom of Information Act requests by the Department of Homeland Security.
Please let me know right away if you require any additional information or clarification regarding my request for classification as a member of the news media, as well as regarding my concurrent request for a waiver of fees in light of the public interest to be served by this request.
Respectfully,
Shawn Musgrave

It is unclear how the portion of the request regarding emails from the USCG attorney would be appropriately assigned to DHS rather than USCG.
Please advise immediately.

To Whom It May Concern:
I hereby appeal my classification as a commercial requester for the purposes of fees for FOIA request 2015-HQFO-00091.
In my November 6, 2014 followup to my original request, I clearly indicated that I was acting in a journalistic capacity for this request by providing extensive indication of past publication across a range of subjects, including regarding FOIA policy matters and the Department of Homeland Security, in particular.
As such, I request that my fee status be changed to the appropriate category of media request.
Respectfully,
Shawn Musgrave
