This is an appeal of the rejection in its entirety of FOIA 14-1239, in which I requested a number the following CONOPS documents:
-Joint OAM-USCG Maritime UAS CONOPS
-CONOPS for OAM P-3 Airborne Early Warning (AEW) and Long Range Tracking Aircraft
-USCG CONOPS for a Land-Based UAS
-USCG CONOPS for a Cutter-Based UAS
-National CONOPS for MDA
-Broad Area Maritime surveillance UAS CONOPS
- DOD Joint CONOPS for UASs
-DOD Joint Integrated Product Team Unmanned Aircraft System Airspace Integration CONOPS
-Joint Planning and Development Office CONOPS for the Next Generation Air
Transportation System (NextGen)
Foremost, the USCG FOIA staff failed to respond to my request in its entirety. The attached response letter dated October 21, 2014 — a year to the day since the request passed into CBP's possession from DHS headquarters FOIA staff — refers only to the CONOPS for a Land-Based UAS and the CONOPS for a Cutter-Based UAS. The rejection letter makes no mention of the remaining requested documents. Notably, the first document listed above refers specifically to the USCG. Please remand this request back to USCG FOIA staff for a good faith search for all requested documents, particularly in light of the considerable delay in USCG's processing of this request.
Next, the USCG rejection letter dubiously claims a pre-decisional exemption for a program that has been in operation for several years. Furthermore, the rejection letter fails to address the possibility for partial release of portions of identified documents, as well as the current CONOPS under which USCG UAS currently operate.
In light of the above as well as any other reasons identified by the appeals officer, I ask that this request be remanded back to USCG FOIA staff for good faith search and release of all responsive documents.
