Pursuant to the Freedom of Information Act, I hereby request the following records:
The following materials provided to the DHS Office of the Inspector General pertaining to its November 2018 management alert regarding use of 1509 summonses by Customs and Border Protection (OIG-18-18):
- The May 25, 2017 email sent by the Executive Director of CBP's Office of Professional Responsibility, Investigative Operations Division "clarifying the limited contexts in which Section 1509 Summonses may properly be used." (This email is excerpted on page 3 of the alert.)
- Data provided by CBP to the OIG, as described in the management alert: "Data provided by CBP to DHS OIG indicates that DHS 3115 regularly has been used by CBP OPR personnel in violation of the policy."
- CBP's 90-day update letter to the OIG with regard to its progress meeting its commitments in response to the OIG's recommendations.
As I am a professional reporter who has covered DHS and CBP extensively, I assert that I am appropriately categorized as a "media requester" for the purpose of fess. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
