1. The Army Contracting Command referred Group F of your Freedom of Information Act (FOIA) request to the 411th Contracting Support Brigade today.
Our FOIA case number for this part of your request is FA-17-0001. Please reference this case number in any future communications with this office.
2. You requested contracts with Deloitte/Deloitte Consulting from FY 2011 to the processing date of this request.
This command only issued one responsive contract: W91QVN-16-F-0070.
3. Exemption 4 [5 U.S.C. § 552(b)(4)], is intended to protect trade secrets and commercial or financial information obtained from a person that is privileged or confidential, such as unit pricing information as shown under the contract line items numbers (CLINs), financial information, and award fee information.
Therefore, please let me know whether you will accept redacted records.

This email is our initial response to your Freedom of Information Act (FOIA) request dated August 8, 2016, FOIA Case Number 17-0004, wherein you requested copies of contract between this agency and Deloitte/Deloitte Consulting from FY 2011 to the present. A portion of your request was referred to this office on October 6, 2016 for a direct response to you.
Attached please find a copy of purchase order W56HZV-16-P-0234 and a redacted copy of contract W56HZV-15-A-0009. The labor rates in contract W56HZV-15-A-0009 were determined to be exempt from release pursuant to exemption 4 of the FOIA (5 U.S.C. 552(b)(4)) which protects from release ".trade secrets and commercial information or financial information obtained from a person that is privileged or confidential." Per the decision in National Parks & Conservation Association v. Morton, 498 F .2d 765 (D.C. Cir. 1974), a commercial or financial matter is "confidential" for purposes of Exemption 4 if disclosure of the information is likely to have either one of two effects: to impair the government's ability to obtain necessary information in the future or to cause substantial harm to the competitive position of the person from whom the information was obtained.
In an effort to minimize further delay, we request that you review the redactions and identify any withheld information that you wish to receive. If you do request the withheld information, the Government will then notify the submitter of the information, in accordance with Executive Order 12600, to obtain any objections they may have to its release. The Government will then determine whether the release of the information is proper under the FOIA and provide it in a final response letter. If we do not receive any notification from you, which specifically requests the release of any redacted information by March 7, 2017, this letter will become our final response and we will close this FOIA request.
If at any time you are not satisfied that a diligent effort was made to process your request, you may file an administrative appeal to the Secretary of the Army. Any such appeal should be addressed to this office for forwarding to the Army Office of the General Counsel for final disposition on behalf of the Secretary of the Army. To meet the deadline for the appeal, your letter must be received by our FOIA office and forwarded to the Secretary of the Army within (60) days of the date of this letter and include a statement regarding why you believe an adequate search was not conducted.
