To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

-All issues of the Declined Detainer Outcome Report (or other equivalent report(s) that collate data on criminal outcomes and/or criminal background of individuals for whom an ICE detainer was declined by the holding jurisdiction) prepared from December 2000 to the day this request is processed.

To assist in your search for responsive records and data, please note the following:
-An October 2014 version of this report has been posted online here: http://cis.org/sites/cis.org/files/Declined%20detainers%20report_0.pdf

-In a May 2016 letter (see: https://oig.justice.gov/reports/2016/1607.pdf) to the Assistant Attorney General for the Office of Justice Programs, the Justice Department Inspector General noted that it received a draft report dated December 2, 2014, and information indicating that an updated copy of the declined detainer report was provided to Congress on April 16, 2016.

-The same letter from the DOJ OIG cited another version of the declined detainer report which covered declined detainers from January 1, 2014 through June 30, 2015.

As I am a full-time reporter who has covered the Department of Homeland Security and the Department of Justice, I assert that I am appropriately categorized as a media requester for the purpose of fees.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Shawn Musgrave
