MuckRock spoke with Jane Edmonds, who advised that the requested DEA Microgram Bulletin materials were posted online at the agency's website:

http://www.justice.gov/dea/programs/forensicsci/microgram/bulletins_index.html

From: Rich Jones

I requested the documents from January 2010 - May 2011, which are not available online due to a a change in Microgram Bulletin policy.

This is a request for the 'LE' edition of Microgram, which is published to Law Enforcement only.

From: "Edmonds, Jane R" <Jane.R.Edmonds@usdoj.gov>

LE edition is no releaseable in the Freedom of Information Act.
Per your letter you asked for May 1984 to December 2002. Not Jan. 2010
to May 2011.
That would be considered another request. All of the information that
is releaseable is on DEA.gov

To Whom It May Concern:

This is a request under the Freedom of Information Act.

I would like OGIS assistance regarding the rejections of FOIA requests
made to the Drug Enforcement Agency (US Department of Justice). The
two requests were combined and given the request number #11-00313-F. I
believe there request agent was confused about the content of the
request.

I requested "All DEA Microgram Bulletins from May 1984 to December
2002" and "All DEA Microgram Bulletins (Law Enforcement Edition) for
January 2010 through May 2011," and was directed to visit the DEA
website.

The DEA Microgram is a regular newsletter put out by the DEA, and many
of the editions are online.

However, I was requesting the specific documents which were NOT
available on the website. When I appealed this with additional
information, I received a canned response and the case was closed.

The most recent editions of this publication have been marked "Law
Enforcement Edition," however, I believe this is not a valid reason to
deny a Freedom of Information Act Request.

I would appreciate assistance mediating this request.

Thanks,

Rich Jones

Mr. Jones,

I wanted to introduce myself as the staff member from the Office of Government Information Services who will be working with you to try to sort out this matter with the DEA. As we mentioned in our letter to you earlier this week, if you could send us back the signed consent document as well as any of the additional correspondence between yourself and DEA/DOJ, that would be helpful.

I also wanted to let you know that I'm unfortunately headed out on a long vacation tomorrow. I will be back in a few weeks and will connect with you when I return (April 9) if I have any further questions. Otherwise, I'll plan to jump right in with DEA once I get back your Privacy Act consent and related correspondence.

If you have any questions, please let me know and we can talk as soon as I return. Thanks for your patience.

Hi Corinna,

Is the attached digital signature acceptable? If not, please just let us know.

A couple of all the correspondence is available here:

http://www.muckrock.com/foi/view/united-states-of-america/dea-microgram-bulletins-le-january-2010-may-2011/626/

Thanks for your help, and have a wonderful vacation.

From: Corinna Zarek

Mr. Jones,

Thank you for sending the link to your correspondence. Unfortunately, we will need an actual signature (or actual digital signature, as opposed to typed text) for your Privacy Act consent. If you do not have access to a scanner or fax machine, you can print the document, sign it, and mail it back to us.

I also wanted to clarify your request to OGIS. In your initial letter, you state that "This is a request under the Freedom of Information Act." Reading on, you are requesting our assistance with regard to your DEA FOIA request and it does not appear to be a FOIA request of OGIS, but I just want to confirm that with you. You are of course free to make a FOIA request of OGIS, but that would be handled in a different way.

Additionally, might you have a few minutes this week so we could discuss this matter further? Please let me know a good time and number to reach you.

Thank you,
Corinna

Mr. Jones,

I am following up on my message of April 9, 2012. As I mentioned, we will need an actual signature (or digital signature) for your Privacy Act consent in order for me to move forward with your request for assistance regarding your FOIA matter with the DEA. I also wanted to confirm that you were not making a FOIA request of OGIS in your March 11, 2012 request to our office.

Finally, I was hoping to discuss this with you in a brief phone call if possible. I can be reached at 202.741.5777 or I would be glad to call you at a time and number that is convenient for you. I will not be able to take any action on your request to OGIS until I hear back from you.

Thank you,
Corinna

Signed copy attached, and I can confirm that this is not a FOIA request of OGIS itself, it is a request for assistance on a FOIA request of the DEA.
