The records you seek require searches in another office or offices, and so your request falls within " unusual circumstances ." See 5 U.S.C. § 552(a )( 6)(B)(i)-(iii). Because of these unusual circumstances, we are extending the time limit to respond to your request beyond the ten additional days provided by the statute. We have not yet completed a search to determine whether there are records within the scope of your request. The time needed to process your request will necessarily depend on the complexity of our records search and on the volume and complexity of any records located. For your information, this office assigns incoming requests to one of three tracks: simple, complex, or expedited. Each request is then handled on a first-in, first-out basis in relation to other requests in the same track. Simple requests usually receive a response in approximately one month, whereas complex requests necessarily take longer. At this time, your request has been assigned to the complex track. Dear Sophia Ferguson: This letter responds to your Freedom of InformationAct/Privacy Act (FOIA/PA) request dated February 13, 2022, addressed to theDrug Enforcement Administration (DEA), FOIA/PA Unit, seeking access toinformation regarding the above subject. Your request was opened and assigned the above case number. Please include this case number whencommunicating with this office.
Your request as written does not meet the requirements ofthe FOIA, 5 U.S.C. § 552 (a)(3)(A), since they do not reasonably describerecords. The Department of Justicerules, contained at 28 C.F.R. § 16.3, provide that “you must describe therecords in enough detail to enable department personnel to locate them with areasonable amount of effort” and when possible, your request should includespecific information about each record sought such as the date, title or name,author and subject matter of the record. These specifics are important to determine the extent and scope of thesearch, and to determine the records that are responsive. DEA can make certain presumptions to overcomesome of the deficiencies in your request, but not all of them. To retrieve the information that you may be seeking requiresmore specificity. Under the FOIA, anagency is not required to conduct research. DEA maintains several types of records and records systems (i.e.,regulatory, personnel, investigative, etc.). For example, in your letter, you are requesting “Alabama Board ofPharmacy regarding the legality of Delta-8 THC,” yet you have not specified aparticular DEA office that you wish searched; or the type of record that wouldbe responsive to your request. Be advisedthat there are approximately 22 DEA Field Divisions, over 250 domestic offices,and more than 150 Headquarters activities. Since your description did not limit the search to a specific office orarea, a vast majority of DEA offices would be tasked to conduct a search oftheir respective offices for any responsive records pertaining to the subjectof your request. As such, your requestis overly broad and burdensome. DEA is a component of the Department of Justice whoseprimary responsibility is the enforcement of Federal criminal laws related tothe illicit trafficking in controlled substances and chemicals, including theDrug Abuse Prevention and Control Act of 1970, 21 U.S.C. § 801 et seq. See 28 C.F.R. § 0.100. DEA maintains several types of records thatinclude criminal and administrative investigatory records, regulatory records,administrative, program records, financial records and personnel records. Under the FOIA an agency is not required to researcha topic, create records or engage in a far reaching search of every recordsystem to satisfy a FOIA request. To this end, no further action will be initiated on thisrequest until we are in receipt of a reasonable description of records sought. If this office does not receive yourreformulated request within 30 days, DEA will assume that you do not wish topursue this matter and your request will be administratively closed.
