This is a request under the Freedom of Information Act. I hereby request the following records:

Records of all real or perceived security threats made or executed against Davis Dam or Lake Mohave which are on the Colorado river south of
Hoover Dam since Sept. 11, 2000.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Mr. Smathers:

This email acknowledges receipt of your Freedom of Information Act (FOIA) request to the Department of Homeland Security (DHS), Office of Intelligence and Analysis (I&A), dated 4 May, 2011. You are seeking Records of all real or perceived security threats made or executed against Davis Dam or Lake Mohave which are on the Colorado river south of Hoover Dam since Sept. 11, 2000.

Provisions of the Act allow us to recover part of the cost of complying with your request. We shall charge you for records in accordance with the DHS FOIA regulations as they apply to non-commercial requestors. As a non-commercial requestor you will be charged 10-cents a page for duplication, although the first 100 pages are free, as are the first two hours of search time. As per your request, you will be contacted before any fees are accrued.

This is the final response to your Freedom of Information Act (FOIA) request to the Department of Homeland Security (DHS) Office of Intelligence and Analysis (I&A) dated 3 May 2011. You are seeking records of all real or perceived security threats made or executed against Davis Dam or Lake Mohave which are on the Colorado river south of Hoover Dam since Sept. 11, 2000.

We conducted a comprehensive search of files within the Office of Intelligence and Analysis for records that would be responsive to your request. Unfortunately, we were unable to locate or identify any responsive records.

While an adequate search was conducted, you have the right to appeal this determination that no records exist within the Office of Intelligence and Analysis that would be responsive to your request. Should you wish to do so, you must send your appeal and a copy of this letter, within 60 days of the date of this letter, to: Associate General Counsel (General Law), U.S. Department of Homeland Security, Washington, D.C. 20528, following the procedures outlined in the DHS FOIA regulations at 6 C.F.R. ยง 5.9. Your envelope and letter should be marked "FOIA Appeal." Copies of the FOIA and DHS regulations are available at www.dhs.gov/foia.
