This is a request under the Freedom of Information Act. I hereby request the following records:

Records relating to Curtis Roosevelt (April 19, 1930 – September 26, 2016), who was an American writer. He was the son of Anna Roosevelt and her first husband, Curtis Bean Dall. He was the eldest grandson of President Franklin D. Roosevelt and First Lady Eleanor Roosevelt. Please conduct a search of the Central Records System, including but not limited to the Electronic Surveillance (ELSUR) Indices, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, and the Technical Surveillance (TESUR) Indices, for both main-file records and cross-reference records.

I am a member of the news media and request classification as such. I have previously written about the Bureau for AND Magazine, MuckRock and Glomar Disclosure. My articles have been widely read, with some reaching over 100,000 readers. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Please provide an estimated complete date as I have repeatedly requested and which you are legally obligated to provide.

I have twice in a row now explicitly requested this information, but you have failed to provide it. Instead, you have repeatedly and incorrectly referred me to a resource that DOES NOT HAVE THE INFORMATION I AM ASKING.

Your refusal to provide the information is in violation of the statute and caselaw, which require agencies to provide an estimated date of completion when asked.

Continued failure to provide the information requested will be interpreted as bad faith on the part of your agency and used as evidence in future appeals and legal proceedings regarding this request and your agency's continuing pattern of obstruction of FOIA and targeting of my requests in particular, going so far as to repeatedly and demonstrably lie about and throw away thousands of my FOIA requests while also ignoring information in my requests, such as the proof of death or the fact that the person was born over 100 years ago, on top of the conflicting statements from your agency about my FOIA requests and when they were actually processed (connected, unsurprisingly, to your attempts to refuse to process the FOIA request - attempts that, themselves, violate the statute by attempting to cite an exception without citing the exception and without properly processing the request, and ignoring the materials in the request that make that citation moot) and your agencies repeated and direct refusal to perform the searches specified (e.g. providing files that are blatantly not what i asked for, not searching the specified field offices, not performing the cross-reference searches specified, etc.)

I look forward to you complying with the statute and case law and providing the estimated date of completion, as you are LEGALLY REQUIRED TO DO.

If you are somehow still confused, please consult the FOIA and the DOJ's guidance, which explicitly states "Whatever method is utilized to provide status information concerning a given request, the FOIA mandates that both the date of receipt and the estimated date of completion for the request be provided to the requester."

Requests are divided into two tracks--simple (under 50 pages of potentially responsive documents) and complex (over 50 pages of potentially responsive documents). Simple track requests typically require the least amount of time to process. Currently, simple track cases average approximately 181 days from the date of receipt for processing. Our complex requests in the large processing track are currently averaging approximately 659 days for processing.

Your request is currently in the complex request medium processing track, and the estimated date of completion for your request is therefore approximately 232 days from the date of receipt; May 2017. Reducing the scope of your request can accelerate the process as it could potentially place your request in a quicker processing track. This may also reduce any search and duplication costs, if applicable, and allow for a more timely receipt of your information. 1. You did not say that in prior correspondence for this FOIA request.
2. Even if you had, it does not answer my question or request for an estimated date of completion, as required by statute.

Thank you for revealing the existing of additional tracks, and contradicting your prior statements that there are two! This is most informative. Please clarify how many additional (sub-)tracks there are.

"This may also reduce any search and duplication costs, if applicable, and allow for a more timely receipt of your information."

You are not legally permitted to charge me search fees, as I am member of the news media as recognized by your agency, not only for this request but for all requests (per caselaw which is quite explicit on this matter). Thank you for the false information and the threat to levy fees and costs you are not legally allowed to assess.

Thank you, however, for finally providing the legally required estimated date of completion. I'm very sorry that it took so many emails to get this information. If there's a simpler or more direct way I can request it than "please provide an estimated date of completion", I would be happy to comply with that.
