Greetings,

Please be advised that this office has no records, it only serves as the referral point and policy office for the Department of the Army Freedom of Information Act (FOIA). Requests for information and documents under the purview of the Army are referred to the proponent agency for appropriate handling in accordance with Army Regulation 25-55, The Army Freedom of Information Act program.

The FOIA only provides the means by which the public can request specific documents from the Army. The FOIA does not require Federal agencies to respond to questions, render opinions, do legal research, compile or analyze data, or conduct surveys for members of the public.

Your request is still in queue to be processed. By law, we process requests on a first-in, first-out basis and unfortunately, due to an increase of requests and shortage of personnel, our processing time has increased. However, requests are being processed as quickly as possible. Our office will contact you if any additional information is required. Otherwise, you will receive a letter from the action officer once the referral has been processed informing you of which Army Activity it was sent to for processing and direct response to you.

Thank you,
DA FOIA Office

Good Morning,

Please be advised that this office has no records, it only serves as the referral point and policy office for the Department of the Army Freedom of Information Act (FOIA). Requests for information and documents under the purview of the Army are referred to the proponent agency for appropriate handling in accordance with Army Regulation 25-55, The Army Freedom of Information Act program.

Per AR 25-55, requesters must include a statement regarding their willingness to pay all fees or those up to a specified amount. Please keep in mind that this is just a statement regarding your willingness to pay fees; it does not mean that you will necessarily be charged fees. You can indicate that you are only willing to pay up to a certain amount (e.g. $5.00) and request to be contacted if the estimated fees exceed that amount. Alternatively, you may also request a fee waiver or reduction in fees. However, fees must be addressed before we can move forward with your request.

As indicated above, this office is a referral point and by law, we processes referrals on a first-in, first-out basis. Unfortunately, due to an influx of requests and shortage of personnel, our processing time has increased and it could take a few more weeks before your request reaches the front of the queue. The Army Activity most likely to have records responsive to your request below would be the U.S. Army Court of Criminal Appeals . For a quicker response, we would suggest that you resubmit your request directly to their FOIA Office. Their contact information is provided below for your convenience:

U.S. Army Legal Services Agency
U.S. Army Court of Criminal Appeals
9275 Gunston Road
Fort Belvoir, VA 22060
Phone: 703-693-1313
Email: usarmy.pentagon.hqda-otjag.mbx.clerk-of-court-foia@mail.mil<mailto:usarmy.pentagon.hqda-otjag.mbx.clerk-of-court-foia@mail.mil>

We ask that you please respond to this e-mail and let us know if you choose to resubmit your FOIA request to their FOIA office directly so that we can administratively close out your request in our office in an effort to prevent duplication.

If you choose not to resubmit your request to their office, then we ask that you respond back to this e-mail in 7 days with a statement regarding your willingness to pay fees and provide the date or date range of the requested court-martial. If we do not hear back from you we will assume you are no longer interested in your FOIA request and your request will be administratively closed.

Thank you,
DA FOIA Office
