Seeking correspondence between the Department of Commerce and the Student and Exchange Visitor Program of U.S. Immigrations and Customs Enforcement from 2010-present related to F-1 student visa programs and Study in The USA and Study New Jersey and the OPT and CPT programs.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am writing to address to your FOIA request DOC-OS-2015-001425. The FOIA Specialist that you previously communicated with about this request is out of the office on extended leave. I will now handle the processing of your request. Please feel free to contact me with any questions or concerns.

In an email below, you ask about the “not billable” determination made by my colleague. To the best I can tell, you requested a fee waiver, and the fee waiver was neither granted nor denied. The “not billable” determination means that my colleague decided that you will not be charged for the processing of this request.

Additionally, please respond to clarify your request. You are seeking “correspondence between the Department of Commerce and the Student and Exchange Visitor Program of U.S. Immigrations and Customs Enforcement from 2010-present related to F-1 student visa programs and Study in The USA and Study New Jersey and the OPT and CPT programs”, but this does not provide enough information for me to initiate a search process.

The Department is made up of 12 decentralized bureaus (list below) and the Office of the Secretary. The Department does not have a centralized record keeping system, and each bureau independently processes FOIA requests. In your clarification, please list the bureaus that you believe possess responsive records.

Additionally, the Department’s FOIA Regulations provide helpful information for further clarifying your request: A request “must reasonably describe the agency records sought . . . a request should include specific information about each record sought, such as the date, title or name, author, recipient, and subject matter of the record, and the name and location of the office where the record might be found. . . . any file designations or descriptions of the requested records should be included. . . . the more specifically the request describes the records sought, the greater the likelihood that the Department will be able to locate those records.” 15 C.F.R. § 4.3(c).

Please respond to clarify your request. The Department will close your request if you do not respond within 30 calendar days.
