All contracts, subcontracts, budget plans, and any other agreements between your agency and any other party related to the planning, funding, construction, and closure of the TCF Regional Care Center located in Detroit, MI between the dates of 3/1/2020 and 6/1/2020. 2. All contracts, subcontracts, budget plans, and any other agreements between your agency and any other party related to the planning, funding, construction, and closure of the Suburban Collection Showplace Field Hospital located in Novi, MI between the dates of 3/1/2020 and 6/1/2020. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In order to help determine my status for fees, you should know that I am a freelance journalist whose work has been published by print and digital news outlets and magazines in Michigan and in other states, as well as by national outlets. Disclosure of the requested information to me is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government and is not primarily in my commercial interest.

Because this request is being made as part of a news-gathering effort with a high likelihood of publication, and because the requested information has already been provided to other parties as part of a lawsuit, I request a waiver of all fees.


In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I am willing to pay up to $25 for the requested information. If there is a fee that exceeds that amount, please notify me prior to initiating work on the request.

FEMA-FOIA@fema.dhs.gov In regards to your request for afee waiver, the DHS FOIA Regulations at 6 CFR §5.11(k)(2) set forth sixfactors DHS is required to evaluate in determining whether the applicable legalstandard for a fee waiver has been met:  (1) Whether the subject of therequested records concerns “the operations or activities of the government;”(2) Whether the disclosure is “likely to contribute” to an understanding ofgovernment operations or activities; (3) Whether disclosure of the requestedinformation will contribute to the understanding of the public at large, asopposed to the individual understanding  of the requestor or a narrowsegment of interested persons; (4) Whether the contribution to publicunderstanding of government operations or activities will be “significant;” (5)Whether the requester has a commercial interest that would be furthered by therequested disclosure; and (6) Whether the magnitude of any identifiedcommercial interest to the requestor is sufficiently large in comparison withthe public interest in disclosure, that disclosure is primarily in thecommercial interest of the requestor. Upon review of your request andan evaluation of the six factors identified above, DHS has determined that itwill conditionally grant your request for a fee waiver. The fee waiver determination will be basedupon a sampling of the responsive documents received from the various DHSprogram offices as a result of the searches conducted in response to your FOIArequest. DHS will, pursuant to DHSregulations applicable to non-commercial requestors, provide two hours ofsearch time and process the first 100 pages at no charge to you. If upon further determination that, DHSdetermines that the disclosure of the information contained in those documentsdoes not meet the factors permitting DHS to waive the fees then DHS will atthat time either deny your request for a fee waiver entirely or allow for apercentage reduction in the amount of the fees corresponding to the amount ofrelevant material found that meets the factors allowing for a fee waiver.
