Pursuant to the District of Columbia Freedom of Information Act of 1974, D.C. Code Ann. § 2-531 et seq. ("D.C. Act"), I hereby request the following records:

All email communications between DDOE and the Environmental Law Institute (email domain @eli.org) from July 1, 2013 to the present.

I also request that fees be waived because this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

The District Department of the Environment (DDOE) has received your recent request under the District’s Freedom of Information Act (FOIA), D.C. Official Code § 2-531, et seq., and the implementing regulations found in Title 1, Chapter 4 of the District of Columbia Municipal Regulations (“DCMR”).

Your request has been assigned the tracking number listed above. Please use this number in all communications referring to this request. Your request has been reviewed and distributed to all appropriate DDOE programs. After all DDOE programs have completed their search, you will be notified by electronic mail, as to whether or not pertinent records exist. If pertinent records exist, the notification letter will contain instructions for reviewing the records.

There may be fees associated with the search, whether or not pertinent records are located. The FOIA fees are limited to standard charges for direct document search, review, and duplication. (1 DCMR § 408.) The first hour of search time is free of charge. Thereafter, fees will be charged as follows:

Search and initial review time:

Position Type Salary Grade Rate Per Quarter Hour
Clerical Grades DS 1 through 8 $4.00
Professional Grades DS 9 through 13 $7.00
Supervisor Grades DS 14 and above $10.00
Photocopying fees are charged at $0.25 per page. A charge of $1.00 shall be made for each certification of true copies of agency records.

If you have not requested a waiver or reduction of fees (1 DCMR § 408.10), you will be required to pay the fees as calculated using the above scale. You will be notified of the total fees assessed and be required to pay in full prior to DDOE providing the requested information. 1 DCMR § 408.6. If DDOE determines that fees will exceed $250, you may be required to pay the fees in advance of any search, review or duplication. D.C. Official Code § 2-532(b-3).
