Great, but can I have a tracking number on this request so I can use the FDPS as you insist? Until you give me the tracking number, you are failing yet another legal requirement.

FBI appeal

From: Federal Bureau of Investigation

Good afternoon Emma Best,

I am emailing in regards to Administrative Appeal No. DOJ-AP-2020-001417. I am emailing to confirm the tracking number you were provided for the underlying FOIA request. It appears the subject of the request pertained to copies of communications, notes, and other materials regarding OGIS No. 18-00839 and FOIA Request No. 1367327. It appears the FBI issued its final response by letter dated October 31, 2019. Any assistance you can provide would be greatly appreciated.

Thanks very much,

Patrick Austin

Yes and I sent an appeal on November 2nd, 2020 (see https://www.muckrock.com/foi/united-states-of-america-10/comms-re-ogis-case-no-18-00839-and-fbi-foipa-no-1367327-federal-bureau-of-investigation-48660/#comm-806371)

From: Federal Bureau of Investigation

Yes, we're in receipt of the appeal. However, I don't see the tracking number that was assigned to the underlying FOIA request. When you have a moment, please provide the request tracking number.

To clarify, the subject of the request sought communications related to a prior FOIA request (1367327-000) and OGIS No. 18-00839. What tracking number did the FBI provide when processing this request?

Thanks so much for your time and assistance,

Patrick

From: Emma North-Best

You know what, I actually lost my copy of the cover letter with the tracking number on it. I thought it was attached to the appeal when I sent it, but if it wasn't then I suppose we'll simply have to withdraw the appeal?

From: Federal Bureau of Investigation

I understand. Thank you for the prompt response. You have the option to withdraw the appeal, or it may be worthwhile to contact the FOIA Public Liaison to determine if they can locate the relevant request number.

If you decide to withdraw the appeal, you retain the ability to submit a new request seeking the same information.

Please let me know what you decide to do.

Thanks very much and have a great day,

Patrick

From: Emma North-Best

Let's just withdraw the appeal for now. Like you say, I can always refile the request.

Thanks for your time and your patience. All the best.

From: Federal Bureau of Investigation

Thank you for the quick response. I will go ahead and have this appeal withdrawn from our system.
Best regards,

Patrick
