From: Joseph Uchill

To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

The Washington Post reports "But over the summer, momentum has grown among officials in the commerce, diplomatic, trade and technology agencies for a statement from the president 'strongly disavowing' a legislative mandate and supporting widespread encryption, according to senior officials and documents obtained by The Washington Post." (https://www.washingtonpost.com/world/national-security/tech-trade-agencies-push-to-disavow-law-requiring-decryption-of-phones/2015/09/16/1fca5f72-5adf-11e5-b38e-06883aacba64_story.html?postshare=9031442410909976)

I am requesting communications to and from Penny Pritzker (including emails, memoranda and presentations) and any formal reports since March of 2015 discussing the debate over encryption backdoors.

A good set of search terms to find these documents would be anything that mixes a term from "list A" below with a term from "list B:"

A: encryption, crypto, encrypt, cryptography, pgp, gpg, AES256
B: Apple, Google, default, backdoor, back door, frontdoor, front door, comey, NSA, FBI, law enforcement, Comey, Clapper, Johnson, intelligence, warrant

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. I am a reporter with the Christian Science Monitor seeking documents in furtherance of a story, and as a member of the media request a waiver of fees.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Joseph Uchill

Hi,

We have received the office unit responses for processing into a final response. We have sent out referral documents to the originating offices within the Department of Commerce for disclosure review and determination(s). These documents are due back in my office on July 14, 2016 (responsive documents must go to the originator(s) of the documents themselves for disclosure review and determination(s). We have sent a referral document to the U.S. Department of State for direct response to you. In addition, we have sent a document that may or may not have contained business proprietary information and the due date for this document back to my office is July 15, 2016. Upon receipt of these disclosure review determination(s) with the exception of the one referred to the State Department, we should be sending to you a final response.

If you have any further questions, concerns or if I can be of further assistance, you may contact me via e-mail at BParsons@doc.gov<mailto:BParsons@doc.gov> or phone at 202-482-3257.

Hi,

Our records show that we sent an interim response to your FOIA request on June 3, 2016. These documents had to be referred to the originators of the documents. The due date for their disclosure determination back to my office was due back by July 14, 2016, therefore we could have responded back to you on July 15, 2016.. To date, we are waiting one Immediate Office of the Secretary office unit and one DOC bureau to respond. In addition, we sent our documents for business proprietary information to be reviewed and that was due back to us July 15, 2016.

We, actually received an update from the Bureau yesterday. I will, however send an email to the bureau and let them know of your inquiry regarding your FOIA. In addition, I will reach out to the office unit in the Immediate Office of the Secretary for a status check and express that you have sent in inquiry to my office today and ask when I can expect to receive it.

We will be sending out a second interim response to you today.
Thanks,
Bobbie
