Good morning Mr. Smathers,

As stated in a previous email, dated 29 April 2014, your Freedom of
Information Act (FOIA) request titled "Cold Death, Chemical Weapons and Means
of Mass Destruction" does not fall in our agencies purview. We have performed
a search for your requested report and were unable to locate any documents. I
have tried contacting the offices at Fort Detrick and have been unsuccessful.
The only information that I have been able to obtain is the email address

This request was sent to The U.S. Army, Dugway Proving Ground. On the same day, I was informed that the record is "not in [their] purview and does not belong to [their] organization." However, I believe the record is in their possession. Therefore, I appeal the denial of the record based on someone else having purview.

Further, I have asked Fort Detrick FOIA staff to process the request and have not received even an acknowledgement. I was given the email address atusarmy.detrick.usag.mbx.dhr-foia@mail.mil - however, I have not gotten any reply to my inquiries there. Therefore, I appeal the rejection of my FOIA request, I also appeal the refusal to acknowledge the request, I appeal the refusal to assign a FOIA tracking number, and I appeal all search fees based on the fact that a statutory deadline has passed and the 2007 amendments to FOIA prohibit search fees in this situation.

For the reasons herein and all other reasons deemed appropriate by the appeals authority, I hereby appeal.
