re: Freedom of Information Act (FOIA), FOIA No. 19-02001-F
Chemeketa Community College, OCR No. 10182013

This is to acknowledge receipt of your August 7, 2019, request to the Washington, D.C. office in the U.S. Department of Education (Department). You request was transferred to the Seattle Office of the Office for Civil Rights (OCR) in the Department for response. In your request you listed 10 questions about a Title IX complaint filed against Chemeketa Community College (for full list, see the incoming e-mail below). Your request is being processed under the Freedom of Information Act (5 U.S.C. § 552).

Because you have asked questions rather than requested documents, it is necessary to speak with you prior to processing your FOIA request. You have not provided a telephone number at which we may reach you. Please call me at (206) 607-1633 to discuss your request. Your request cannot be completed as currently written. Additionally, you should be aware that as a member of the press, press inquiries are to be directed to the Department’s Press Office at (202) 401-1576 or by e-mail at press@ed.gov.

In the interim please note that since October 2013, OCR has published all resolution letters and agreements for complaints resolved with change. Here is a link to OCR’s Reading Room: https://www2.ed.gov/about/offices/list/ocr/frontpage/faq/readingroom.html Scroll down to “Case Resolutions.”

I have searched for the most recent Title IX case involving Chemeketa CC that resolved with change. Here are links to the resolution documents in the referenced case.
Resolution letter to college

Voluntary Resolution Agreement
https://www2.ed.gov/about/offices/list/ocr/docs/investigations/more/10182013-b.pdf

Please be aware that release of documents may be more restricted when matters are open for evaluation, investigation, resolution, appeal or monitoring (see 5 U.S.C. § 552 (b)(7)(A)). Also note that because of exemptions to disclosure under FOIA, all documents responsive to your request will be redacted to remove the names of all individuals and other personally identifiable information (See (b)(6) and (b)(7)(C)). Generally, our office has 20 working days from receipt of the request in our office to respond in some manner to FOIA requests. For your information, under FOIA, OCR provides the first 100 pages of hard copies free of charge with the remaining pages provided at a copying cost of 20 cents per page. Electronic documents, if voluminous, are provided by compact disc at a charge of $3.00 per disc. The Department's implementing regulations provide two hours of search time without charge. Fees are not assessed if charges are $25 or less. As a member of the news media, you have requested a fee waiver. Generally, our office provides documents in electronic format unless otherwise specified by the requestor.
