Ms. Walton:

This is an appeal for FOIA request 2013-TSFO-01529. In the attached letter dated February 18, 2015, TSA FOIA officers determined that no responsive documents were available, and suggested contacting the Department of Homeland Security Inspector General.

While I have reviewed the DHS OIG's reports regarding allegations of racial profiling at Logan Airport in Boston, a number of media reports and official statements indicated that the TSA had its own internal investigation in addition to that conducted by the Inspector General:

On 08/12/2012, The New York Times reported (http://www.nytimes.com/2012/08/12/us/racial-profiling-at-boston-airport-officials-say.html): "The T.S.A. said on Friday that it had opened an investigation into the claims."

On 08/14/2012, CNN reported (http://www.cnn.com/2012/08/14/travel/tsa-profiling-accusations/index.html), "The claims, first reported in The New York Times, prompted the TSA to open an internal investigation."

The DHS OIG report itself (http://www.oig.dhs.gov/assets/FOIA/OIG-I12-TSA-PHL-00968.pdf) cited a TSA investigation, noting that its investigation was initiated "upon receiving information from the Transportation Security Administration (TSA), Office ofInspection."

In light of the above as well as the common procedure of agencies conducting their own investigations parallel to those conducted by the DHS OIG, I request that you remand this FOIA back to the TSA for a good faith search and release of responsive documents.
