Contracts, invoices, communications with Academi Training Center LLC (H92222-16-D-0036) in support of US Special Operations Command Tampa, Florida, for the years 2015 and 2016 inclusive.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM, DVD-R, or BD-R if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Your request is being processed in accordance with procedural requirements promulgated in Department of Defense (DoD) Regulation 5400.7-R, which is available on the Internet at: http://www.defenselink.mil/pubs.foi/. The actual processing time will depend upon its complexity, whether it involves sensitive records, voluminous records, extensive searches, consultation among DoD components or other agencies, and our administrative workload.

We have placed you in the "News Media" category for fee purposes, which means you are obligated to pay all duplication costs after the first 100 pages; however, depending on the size of the document(s) we may provide the final release on CD or electronically and no charges will be assessed.

The USSOCOM FOIA Office has a substantial number of pending FOIA cases, therefore, we process requests in a multi-track processing system based on the date of receipt and the amount of work and time involved in processing each request. Also, when processing contract information for release under the FOIA, we have a requirement to notify the submitter and give them time to review their contracts to include recommendations for withholding any proprietary information that they would not want released. Hello Mr. Peck,

The U.S. Special Operations Command (USSOCOM) received your Freedom of Information Act (FOIA) request (copy attached) for specific contract information and assigned it USSOCOM FOIA 2016-162.

USSOCOM is in the midst of a protest against the award of this contract, which puts contract H92222-16-D-0036 under litigation; therefore, we are unable to continue processing your FOIA request at this time.

We respectfully ask that you withdraw your current request and resubmit a new one after the protest has been resolved. If you view this as a denial of information, please advise and we will provide you with a copy of your appeal rights.

Please respond whether you agree to withdraw USSOCOM FOIA 2016-162 by close of business on June 29, 2016. If we do not hear from you, we will assume you no longer require this information and simply close the request with no further action.

Good morning Mr. Peck,

We did not deny anything pertaining to your request. We informed you of the
fact the contract you requested is under protest and we could not
continue to process your inquiry at this time because of the protest. We
asked that you withdraw your request and submit another request in the
future once the protest is finalized. We also advised that you respond by
close of business on June 29, 2016, and if we did not hear from you, we
would
assume you no longer required this information and close the request with no
further action.

Since we did not hear from you within the allotted time, we closed your
request as being withdrawn.

You have the right to appeal to the appellate authority, the Director of
Oversight and Compliance, Office of the Secretary of Defense. To submit
