To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

A copy of all documents or FBI files pertaining or mentioning to Bernard Lawrence Madoff, AKA Bernie Maddoff. Bernie Maddoff was an infamous banker and Ponzi schemer. Bernie Maddoff is now deceased, according to numerous news reports (see: https://apnews.com/article/bernie-madoff-dead-9d9bd8065708384e0bf0c840bd1ae711 ) and therefore neither FOIA's b6 exemption nor the Privacy Act relates to him. See also the supporting documentation. His DOB is April 29, 1938 and he died on April 14, 2021.

The request is being made by a member of the news media and I plan to use the original documents and my editorial skills to turn the raw materials into a distinct work. I further intend to distribute my work and the documents to a general audience.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Freddy Martinez

From: Freddy Martinez

FOIA Officers at OIP,

This is an appeal under 5 USC 552 (the Freedom of Information Act) for the FBI's processing of FOIA request 1494946-000. First, I am appealing (At minimum) the adequacy of the FBI's search. The original request was for " all documents or FBI files pertaining or mentioning to Bernard Lawrence Madoff, AKA Bernie Maddoff."

At no point did the FBI contact me, nor did I ever agree to limiting the FBI's request or processing to "Bernard L. Madoff Investment Securities LLC" as the latest response letter seems to indicate.

Please confirm that you are in receipt of my appeal.

Best,
Freddy Martinez
