All contracts between the United States Army and the National Football League, or any organization or individual within the National Football League, dated between 1 January 2010 and 20 October 2015.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Afternoon,

1. This is in response to your August 8, 2016 Freedom of Information Act
(FOIA) email request for copies of All contracts between the United States
Army and the National Football League, or any organization or individual
within the National Football League, dated between 1 January 2010 and 20
October 2015. The MICC FOIA case number for this request is FP-16-027752.
Please reference this case number in any future communications with this
office.

2. In regards to your FOIA request, the following exemptions, if
applicable, will apply.

Exemption 3 [5 U.S.C. Section 552(b)(3)] is intended to protect the release
of records that are exempt from disclosure by statute. 10 U.S.C section
3.104-4 of the federal Acquisition regulation (FAR) generally prohibits
disclosure of contractor bid proposal information, as well as source
selection information. Any section 24-202(a) of the FAR explicitly
prohibits a FOIA release of proposal submitted in response to competitive
solicitations. Therefore, unless the proposals for the contract were
opened publically, this part of your request is exempt from release.

Exemption 4 [5 U.S.C Section 552(b)(4)] is intended to protect trade
secrets and commercial or financial information obtained from a person that
is privileged or confidential, such as unit pricing information as shown
under the contract line items numbers(CLINS) financial information, and
award fee information.

Exemption 6 [5 U.S.C Section 552 (b)(6)] is intended to protect personnel
and medical files from mandatory disclosure where doing so would constitute
a clearly unwarranted invasion of privacy. We will be withholding the
email addresses, phone numbers, and signature of government employees under
Exemption (b)(6) to protect personal privacy. Disclosure of this
information would contribute little to the public understanding of
government activities. By contrast, such disclosure would constitute a non-
trivial and not insubstantial invasion of government employees privacy
interests.

3. Please let me know whether you will accept a conformed copy of the
contract and any modifications. A conformed copy is a copy of the contract
as it is today, with all the modifications incorporated.

4. I have tasked our MICC-West Point office to respond to your request.

5. Under the Freedom of Information Act (FOIA), the period for determining
whether to comply with a request is 20 working days, and may be extended to
30 working days, 5 U.S.C. § 552(a)(6)(A)(i). The time it takes to respond
to a request will vary depending on the complexity of the request and the
backlog of pending requests. Because we are required to address a large
number of FOIA demands, we cannot always respond to requests as quickly as
we would like. Accordingly, we handle backlogged cases on a "first in,
first out" basis, a practice that has been recognized by the courts. Based
on the current volume of requests, our current average processing times is
approximately 90 days from the date of receipt.
