Mr. Smathers:

On the subject of the April 2011 - Present deceased letters. I received
responses to the request. However, upon review of the deceased letters, they
follow the same format with the exception of the names and addresses of the
Marine's families which in this case they will not be identified under the (b)(6)
of the FOIA.

I find I do need clarity at this point. What is it exactly that you
require from these letters? The names of the deceased Marines? Pls. write back.
I asked you a question about another issue and I did not receive a response
from you.

I am also keeping track of our email transmissions.

I have received similar records in the past and although many such letters are a template, others were customized. I would like to see each letter including the name of the deceased. However, I am not interested in the information of the recipient of the letter.

Thank you.

From: Hughes CIV Sally

Mr. Smathers -- Ms. Malone of my office forwarded your email to me. Please find attached our final response to you in this matter, which we sent out in April. Should you have further questions/concerns, please feel free to contact me directly.

From: Jason Smathers

I appeal. The privacy exemption of FOIA does not apply to the deceased. These letters are about the deceased and have been released in the past. On these grounds and all other grounds deemed appropriate by the appeals authority, I appeal.

Mr. Smathers -- I'm afraid my office is not an appellate authority. Please refer to the response letter that I re-sent to you this afternoon; your appeal rights and procedures are set forth in detail in that correspondence.

I believe this request is timely because I received the final determination letter on September 11, 2013. My first attempt to appeal did not make note of this because I believed the letter to be recent, since I sent my appeal the same day I received the rejection letter. I do not know why the rejection letter dated in April was not received, however, I did not receive it until 9/11/13.
