The agency unlawfully "closed" this FOIA request without any statutory basis. The agency failed to conduct an adequate search. The agency withheld responsive, non-exempt records.
Although the closure letter referenced a prior FOIA request which sought similar records, since May 1, 2018 requester had not received any acknowledgment of receipt of that request or a tracking number.
In any event the agency violated the statute by not making a determination within the statutory period and has failed to explain why it cannot produce the requested records.
