To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

Records relating to or mentioning Abner Joseph Mikva (January 21, 1926 – July 4, 2016) was an American politician, federal judge, lawyer and law professor. His death has been widely reported. http://www.nytimes.com/2016/07/06/us/abner-mikva-lawmaker-judge-and-mentor-to-obama-dies-at-90.html

Please conduct a search of the Central Records System, including but not limited to the Electronic Surveillance (ELSUR) Indices, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, and the Technical Surveillance (TESUR) Indices, for both main-file records and cross-reference records.

I am a member of the news media and request classification as such. I have previously written about the Bureau for AND Magazine, MuckRock and Glomar Disclosure.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

An acknowledgement letter, stating the request is being processed.

From: Wilson, Leslie C. (RMD) (FBI)

Good afternoon Ms. Best,

I just wanted to inform you of your request on Abner Joseph Mikva, FOIA 1357156-0. Your request came over for negotiations; however, it appears that by first in on a subject, the main file will be processed in another request. Therefore, the portion of your request for cross-references does not exceed the limit for the medium-track processing queue. However, the cross-references will not be addressed until the main file records have been completed. Since there were several requesters on the subject, it is likely the processing of the main file sections will be uploaded on "the vault" upon completion. Your materials for cross-references then will be reviewed. If at this time, you decide not to proceed with cross-reference (just under 900 pages), please let me know.

Thanks for your time and consideration,

Leslie Wilson

From: Emma Best

We can eliminate the cross-references. Thanks (and sorry about the delay)!

From: Federal Bureau of Investigation

A fix is required to perfect the request.

From: Emma Best

I am appealing the integrity of the search, as negotiations clearly showed that the scope was outside what is posted to the FBI's website, and that additional records DID exist.
