Pursuant to the Freedom of Information Act, I hereby request the following records:

I'm looking for any memos, emails, texts, and reports between officials from the U.S. Department of Housing and Urban Development and Salvador Menjivar and other staff members of the San Francisco Department of Homelessness and Supportive Housing relating to a workshop/forensic audit of unspent federal money that took place sometime between September 1, 2020 and January 15, 2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This letter acknowledges the U.S. Department of Housing and Urban Development's receipt of your Freedom of Information Act ("FOIA") request dated February 25, 2021 . Your request was received in the Department's FOIA Office on March 2, 2021. The assigned tracking number is 21-FI-RO9-00717. Please use this in all future correspondence

Under the Freedom of Information Act, you have requested:

"I'm looking for any memos, emails, texts, and reports between officials from the U.S. Department of Housing and Urban Development and Salvador Menjivar and other staff members of the San Francisco Department of Homelessness and Supportive Housing relating to a workshop/forensic audit of unspent federal money that took place sometime between September 1, 2020 and January 15, 2021."

Pursuant to the FOIA, 5 USC § 552(a)(6)(A)(i), once HUD properly receives a FOIA request, the Department has 20 working days within which to make a determination on the request. Under the FOIA, the Department may extend the 20-day response time when "unusual circumstances" exist. Unusual circumstances exist in one of the following three situations:

1. The component needs to search for and collect responsive records from a field office or other entity separate from the office processing the request;
2. The request involves a "voluminous" amount of records that must be located, compiled, and reviewed; or
3. The component needs to consult with another federal agency or two or more HUD components that have a substantial interest in the responsive information.

When an extension of time beyond 10 additional days is needed, the component will notify the requester in writing and offer the opportunity to modify or limit the scope of his or her request, or to arrange for an alternative time frame for completion of the component's processing. The component will also make available its FOIA Public Liaison to assist in the process. As of date of letter, HUD's Region IX's FOIA Office has 12 open requests. Based upon HUD's experience and current inventory, it is estimated that it may take 20 days to complete processing of your request.

HUD's policy is to process FOIA requests using "multi-track processing," which allows the Department to process FOIA requests on a first-in/first-out basis, within each track. HUD places FOIA requests in its routine or complex track based on the amount of work and time involved in processing the request. The criteria for assignment to a specific track are found in HUD's FOIA regulations, 24 C.F.R. § 15.104(d), which were published in the Federal Register on August 17, 2015, at 80 FR 49145, as amended 82 FR 3622 on January 12, 2017. Your request is being processed on the routine track. Please note that upon further evaluation of your request, you may be notified that your request has been transferred to another track. The Department will comply with your request to the extent permissible by law. Any records not subject to an exemption will be forwarded to you promptly upon the completion of HUD's search and review process.

Your request has been categorized as other requester. The FOIA fee categories are defined in HUD's FOIA regulations, 24 C.F.R. § 15.106(b).

Your request has been assigned to the Office of Community Planning and Development in HUD's San Francisco Regional Office for processing.
