This is a request under the Freedom of Information Act. I hereby request the following records:
A copy of the entire 2009 Mosques of America Calendar produced or distributed by or for the department of state.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

In a letter dated July 13 2012, Sheryl L. Walter provided a no records response to FOIA Case F-2011-07755. I appeal this adverse determination.
My request was for "a copy of the entire 2009 Mosques of America Calendar produced or distributed by or for the department of state."
Ms. Walter 's letter states "GPS advises us that these calendars are no longer available." In this highly disingenuous reply, she carefully did not say they couldn't find an electronic copy or a proof copy, etc., only that they couldn't find any more calendars.
Although they may have tossed the calenders, they did not eradicate every digital copy of them.
I appeal on the grounds that it is inconceivable that they could have eradicated every last digital copy of the calendar as well as any other grounds the appeal authority deems appropriate.
