classification as such. I have previously written about the
government and
its activities, with some reaching over 100,000 readers in
outlets such as
Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and
The Outline, among others. As such, as I have a reasonable expectation of
publication and my editorial and writing skills are well established. In
addition, I discuss and comment on the files online and make
them available
through non-profits such as the library Internet Archive and the
journalist
non-profit MuckRock, disseminating them to a large audience. While my
research is not limited to this, a great deal of it, including this,
focuses on the activities and attitudes of the government
itself. As such,
it is not necessary for me to demonstrate the relevance of this
particular
subject in advance. Further, case law states that “proof of the
ability to
disseminate the released information to a broad cross- section of the
public is not required.” Judicial Watch, Inc. v. Dep’t of
Justice, 365 F.3d
1108, 1126 (D.C. Cir. 2004); see Carney v. U.S. Dep’t of
Justice, 19 F. 3d
807, 814-15 (2d Cir. 1994). Further, courts have held that "qualified
because it also had “firm” plans to “publish a number of . . . ‘document
sets’” concerning United States foreign and national security policy."
Under this criteria, as well, I qualify as a member of the news media.
Additionally, courts have held that the news media status "focuses on the
nature of the requester, not its request. The provision requires that the
request be “made by” a representative of the news media. Id. §
552(a)(4)(A)(ii)(II). A newspaper reporter, for example, is a
representative of the news media regardless of how much interest there is
in the story for which he or she is requesting information." As such, the
details of the request itself are moot for the purposes of
determining the
appropriate fee category. I request that fees be waived.

This letter is in regards to a FOIA request below which you sent the
National Archives and Records Administration (NARA). NARA’s Office of
General Counsel (NGC) sent your request to the Office of Inspector General
(OIG) for processing. For your information, the OIG is an independent unit
of the National Archives and Records Administration (NARA) tasked by
Congress to combat fraud, waste, abuse and mismanagement within NARA. As
such, we have no control or authority over records kept and maintained by
any other government agency, or even any office at NARA. We only control
those records generated within the OIG alone. Accordingly, no other office

Thank you very much for your patience. Your request and the potentially
responsive records were sent to the Federal Bureau of Investigation (FBI)
and were assigned FBI FOI/PA Request # 1452563-00. The FBI determined all
7,289 pages originated in an investigative file which is exempt from
disclosure pursuant to Title 5, United States Code, Section 552, subsection
b(7)(A) (Exemption b(7)(A)). Information compiled for law enforcement
purposes that could reasonably be expected to interfere with enforcement
proceedings is withheld from release pursuant to Exemption b(7)(A). After
review the FBI determined records were also covered by several other FOIA
exemptions. Exemptions b(6) and b(7)(C) cover information that constitutes
a clearly unwarranted invasion of personal privacy and/or records compiled
for law enforcement purposes that could reasonably be expected to
constitute an unwarranted invasion of personal privacy. Law enforcement
information which could reasonably be expected to disclose the identity of
a confidential source is covered under Exemption b(7)(D). Information that
would disclose techniques and procedures for law enforcement investigations
or prosecutions which could reasonably be expected to risk circumvention of
the law is covered under Exemption b(7)(E). The FBI has determined all
7,289 pages should be withheld under FOIA Exemptions b(6), b(7)(A),
b(7)(C), b(7)(D), and b(7)(E).

You have the right to administratively appeal those determinations by
writing to the Archivist of the United States, National Archives and
Records Administration, 8601 Adelphi Road, College Park, MD, 20740, within
ninety (90) calendar days of the date of this letter. If you choose to
appeal, your appeal letter and its envelope should be clearly marked
“Freedom of Information Act Appeal,” and you should explain why you believe
NARA should release the withheld information. Any appeal will be
coordinated with the Department of Justice Office of Information Policy
regarding the FBI redactions.

I am appealing the withholdings in their entirety, as no investigation will arise from these records as it is known that they investigated a non-crime – the allegations made are transparently false and those that are accurate are not violations of the law, as made clear by the National Archives' own report on the subject, as well as a cursory review of the law and the known facts: it is not "hacking" or any sort of CFAA violation to download publicly accessible files posted to the National Archives' website expressly for members of the public to view and download.
